1. About Us and These Terms

Welcome to Electricspares! These Terms and Conditions govern your use of our website https://electricspares.co.uk/ (the ‘Site’) and the purchase of products from us.

We are Electricspares Ltd (‘we’, ‘us’, ‘our’), a company registered in the United Kingdom.

Registered address: Stewley Gate, Stewley, Ashill, Ilminster, Somerset, TA19 9NJ, United Kingdom.

VAT number: GB682248126.

These Terms form a legally binding agreement between you (‘you’, ‘your’) and us. By accessing our Site and purchasing our products, you agree to be bound by these Terms. We recommend you print a copy for your records.

We reserve the right to modify these Terms from time to time by updating this page. Your continued use of the Site after changes are posted will constitute your acceptance of the new terms.

2. How to Contact Us

To resolve a complaint or for further information, please visit our ‘Contact Us’ page to send us a message. We do not publish direct email addresses to ensure enquiries are managed effectively through our contact form.

3. Placing an Order

When you place an order on our Site, you are making an offer to purchase the goods.

You will receive an order acknowledgement email; however, this does not mean your order has been accepted. A legally binding contract is formed only when we despatch your goods and send you a despatch confirmation.

We reserve the right to refuse any order. This may be for reasons such as the item being out of stock, a pricing error, or if we suspect fraudulent activity. We may also limit or prohibit orders that appear to be placed by dealers or resellers for commercial resale, unless by prior arrangement.

4. Our Products

We sell electrical spare parts and related items (‘Products’).

We make every effort to display the Products and their specifications accurately. However, images are for illustrative purposes only, and we cannot guarantee that your device’s display will perfectly reflect the true colour or detail of the Product.

All Products are subject to availability. We reserve the right to discontinue any Product at any time.

5. Pricing, VAT and International Orders

Currency and Payment: All payments are to be made in Pound Sterling (£). We accept payment via Visa, Mastercard, and PayPal. You agree to provide current and accurate payment information for all purchases.

Display of Prices & VAT:

  • By default, prices shown on our product and category pages exclude VAT.
  • You can use the VAT switch on our website to display prices inclusive of VAT. The site will remember your preference for future visits.
  • In the shopping cart and at checkout, the final price is broken down clearly. You will see the subtotal of goods excluding VAT, a separate line item for the VAT amount, and the final, total price payable which includes VAT.

Pricing Errors: While we take care to ensure all prices are accurate, errors may occur. If we discover a pricing error with your order, we will contact you as soon as possible. We reserve the right to correct any pricing errors, even after receiving payment.

International Orders and Import Fees:

  • For orders being delivered to a destination outside the UK, UK VAT will be automatically removed from your order total at checkout once you enter your delivery address.
  • Please be aware that you, the buyer, are responsible for any and all local import duties, taxes, and customs clearance fees that may be levied by your country’s authorities. These charges are not included in the product price or shipping cost and are your sole responsibility. We will not be liable for these charges.

6. User Accounts

You have the option to register for a user account or check out as a guest.

If you create an account, you agree to keep your password confidential and accept responsibility for all activities that occur under your account.

7. Customer Types: Consumers and Businesses

These terms apply to two different types of customers:

Consumers: An individual purchasing Products for purposes wholly or mainly outside of their trade, business, craft, or profession.

Business Customers: A person, company, or entity purchasing Products for purposes relating to their trade, business, craft, or profession (e.g., an electrician or trade member).

Your legal rights differ depending on whether you are a Consumer or a Business Customer.

8. Rights for Consumer Customers

This section applies only if you are a Consumer.

Your Right to Change Your Mind: You have a legal right to change your mind and return an unwanted item. We offer a generous 30-day period to do this, starting from the day you receive your order. Please see our Returns & Refunds Policy for full details on how to return an item and any conditions that apply.

Your Rights for Faulty Goods: Under the Consumer Rights Act 2015, goods must be as described, fit for purpose, and of satisfactory quality. If a Product you buy is faulty, you have the right to a refund, repair, or replacement. Our Returns & Refunds Policy explains this process in detail.

9. Terms for Business Customers

This section applies only if you are a Business Customer.

Consumer Regulations: You acknowledge that consumer protection regulations (such as the Consumer Contracts Regulations 2013 and parts of the Consumer Rights Act 2015) do not apply to transactions with us.

Returns: Returns for non-faulty goods are at our sole discretion. Please contact us to discuss any potential return.

Liability: Our liability to you for any loss or damage arising under or in connection with an order shall be limited to the price of the Products in that order. We shall not be liable for any indirect or consequential loss, loss of profit, or loss of business. This does not limit our liability for anything that cannot be legally limited or excluded, such as death or personal injury caused by our negligence.

10. User Content (Reviews and Comments)

Our Site allows you to post product reviews and ask questions on our articles (‘Contributions’).

By posting Contributions, you confirm that you have the right to do so and that your content is not illegal, offensive, defamatory, or in breach of any third-party rights.

You are solely responsible for your Contributions. We have the right, but not the obligation, to monitor, edit, or remove any Contributions we deem inappropriate.

By posting, you grant us a worldwide, perpetual, non-exclusive, royalty-free licence to use, reproduce, publish, and display your Contributions in connection with our business (e.g., showing your review on a product page).

11. Intellectual Property

We are the owner or licensee of all intellectual property rights on our Site, including all text, graphics, logos, and software (‘Content’).

You may use the Site and its Content for your personal, non-commercial use only. You must not copy, reproduce, or exploit any part of our Site for any commercial purpose without our prior written permission.

Please review our Privacy Policy for full details on what data we collect, how we use it, and your rights. By using our Site, you agree to be bound by our Privacy Policy.

13. General

We shall not be liable for any delay or failure to perform our obligations if such delay or failure is caused by an event beyond our reasonable control.

If any part of these Terms is found to be unlawful or unenforceable, that part shall be deemed severable and shall not affect the validity of the remaining provisions.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the law of England and Wales.

You agree to submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim.
